Terms of Service

1. Agreement to terms

These Terms of Service ("Terms") form a binding agreement between you and Endval ("we," "us," or "the Service"). By creating an account, checking the box that states you agree to these Terms and the Investment Disclaimer, subscribing, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

Electronic acceptance (including clickwrap confirmation at signup or checkout) has the same legal effect as a signed contract. Terms version: 2026-06-01.

2. Description of service

Endval provides portfolio tracking, market data visualization, and AI-assisted informational tools. The Service is for personal educational and informational purposes only. We do not execute trades, hold custody of assets, manage money on your behalf, or provide personalized investment recommendations.

3. No investment or financial advice

Except as stated in the Investment Disclaimer above, all content, including charts, alerts, portfolio metrics, and AI-generated responses, is general information only and is not tailored to your financial situation, goals, or risk tolerance. Reliance on any information from the Service is solely at your own risk.

4. Accounts and subscriptions

You must provide accurate registration information and keep your credentials secure. Paid subscriptions renew according to the plan you select unless canceled before the renewal date. Free trials convert to paid plans unless canceled during the trial period. Fees are processed by our payment provider (e.g., Stripe). Refunds are handled at our discretion except where required by applicable law.

5. Market data and accuracy

Market prices, portfolio calculations, and third-party data may be delayed, incomplete, or inaccurate. We do not guarantee the timeliness, accuracy, or completeness of any data displayed on the Service. The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.

6. Acceptable use

You may not misuse the Service, attempt unauthorized access, scrape data at scale, reverse engineer our systems, or use the Service in violation of applicable laws or third-party rights.

7. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Endval, ITS OWNERS, OPERATORS, AFFILIATES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR ANY FINANCIAL OR INVESTMENT LOSSES (INCLUDING LOSSES FROM TRADES OR DECISIONS YOU MAKE BASED ON THE SERVICE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL FEES YOU ACTUALLY PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM (FOR EXAMPLE, THE AMOUNT YOU PAID FOR YOUR SUBSCRIPTION). IF YOU HAVE NOT PAID ANY FEES, OUR MAXIMUM LIABILITY TO YOU IS ZERO U.S. DOLLARS ($0).

Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the greatest extent permitted by law.

8. Indemnification

You agree to defend, indemnify, and hold harmless Endval and its affiliates from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

9. Governing law

These Terms and any dispute arising out of or relating to them or the Service shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict-of-law rules. You agree that the state and federal courts located in New Jersey shall have exclusive jurisdiction over such disputes, except where prohibited by law.

10. Severability

If any provision of these Terms is held invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

11. Changes and termination

We may modify these Terms or discontinue features at any time. We will update the "Last updated" date when material changes are made. Continued use after changes constitutes acceptance of the revised Terms. We may suspend or terminate accounts that violate these Terms.
